Terms of Service

These Terms of Service explain the rules for using SaborPatio, what we provide, and what you can expect from us. They also describe important limitations, including that recipes and cooking guidance are provided for general informational purposes. If you do not agree with these terms, do not use the website.

1) Acceptance and eligibility

By accessing or using SaborPatio (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization, and “you” includes the organization.

Minimum age: the Site is intended for users who are at least 16 years old. If you are under 16, you may use the Site only with the involvement and consent of a parent or legal guardian. We do not knowingly request sensitive personal data. Our contact forms are designed for basic communication only.

Your use of the Site must comply with all applicable laws. If you do not agree to these Terms or you cannot meet the eligibility requirements, do not use the Site.

2) Service description

SaborPatio is a recipe and cooking inspiration website dedicated to simple, affordable home meals with Chile-inspired flavors. We publish recipes, meal planning ideas, ingredient tips, and practical techniques for beginner and intermediate home cooks. Content may include written instructions, photos, estimated timing, and suggestions for substitutions.

The Site is provided for informational purposes only. Cooking involves variables outside our control, including ingredient brands, oven calibration, altitude, cookware differences, and food safety practices in the home. You are responsible for using your judgment and following safe food handling and cooking guidelines, including allergy management and appropriate cooking temperatures.

We may update the Site over time, add or remove content, and change how the Site is organized. We do not promise that any specific recipe, guide, or feature will remain available indefinitely.

3) User obligations

You agree to use the Site for lawful purposes and in a way that does not infringe the rights of others. When you contact us, you agree to provide accurate information and to keep your communication respectful and relevant to the Site’s cooking and recipe content.

You agree not to misuse any forms, email addresses, or contact methods published on the Site. If we enable account features in the future, you agree to maintain the confidentiality of your login credentials and to keep one account per person unless we expressly allow otherwise.

4) Intellectual property

The Site and all of its content, including text, recipes, photographs, graphics, branding, design, and code (collectively, the “Content”), are owned by or licensed to SaborPatio LLC and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content for your personal, non-commercial use. This includes printing a recipe for use in your home kitchen or saving a link for later reference. This license does not allow republication, distribution, or commercial exploitation of the Content.

You may not copy, reproduce, republish, upload, post, transmit, translate, sell, license, or otherwise exploit any Content without our prior written permission, except where permitted by law. If you want to reference a recipe, you may link to the relevant page on the Site rather than reproducing the full instructions.

5) Prohibited activities

You agree not to engage in any of the following activities while using the Site:

  • Attempting to gain unauthorized access to the Site, servers, or related systems.
  • Scraping, crawling, or harvesting Content or data using automated tools without permission.
  • Reverse engineering, decompiling, or attempting to extract source code from the Site, except to the extent permitted by law.
  • Impersonating any person or entity, or misrepresenting your affiliation with SaborPatio.
  • Uploading or transmitting malicious code, spam, or any content designed to disrupt the Site.
  • Using the Site to violate any law, regulation, or third-party right, including intellectual property rights.
  • Abusing contact channels through repeated, irrelevant, or harassing messages.

We may take appropriate action if we believe prohibited activity is occurring, including blocking access, limiting functionality, or reporting activity where legally required.

6) Disclaimer of warranties

The Site and Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, SaborPatio LLC disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We also do not guarantee the accuracy, completeness, or usefulness of any Content, including recipe outcomes, cooking times, or ingredient substitutions.

Food safety reminder: You are responsible for safe preparation, cooking, and storage of food, including managing allergies, cross-contamination, and the use of proper internal temperatures. If you have food allergies or dietary restrictions, consult a qualified professional and exercise caution when adapting recipes.

7) Limitation of liability

To the maximum extent permitted by law, SaborPatio LLC will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, or personal injury arising out of or related to your use of (or inability to use) the Site or Content.

To the maximum extent permitted by law, SaborPatio LLC’s total liability for any claim arising out of or relating to the Site or these Terms is limited to the lesser of (a) the amount you paid to us for access to the Site in the 12 months before the event giving rise to the claim, or (b) €100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

8) Indemnification

You agree to indemnify, defend, and hold harmless SaborPatio LLC and its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or your misuse of the Site.

This indemnification obligation includes claims arising from your violation of third-party rights, your unlawful conduct, or your use of automated tools to access or copy Content without permission.

9) Third-party links

The Site may reference or link to third-party websites or services for additional context, such as general cooking references or ingredient background. If we include any such links, they are provided for convenience only.

SaborPatio LLC does not control third-party sites and is not responsible for their content, availability, privacy practices, or terms. Your use of third-party sites is at your own risk, and you should review their policies before providing information or making purchases.

10) Privacy

Our Privacy Policy explains what information we collect, how we use it, and the choices you have. The Privacy Policy is incorporated into these Terms by reference.

Cookies and similar technologies are described in our Cookie Policy. You can manage consent through the cookie banner on the Site and through your browser settings.

11) Governing law and jurisdiction

These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

Subject to the dispute resolution section below, you agree that the state and federal courts located in New York County, New York will have exclusive jurisdiction over disputes arising out of or related to these Terms or the Site, and you consent to personal jurisdiction in those courts.

12) Dispute resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us and providing a brief description of the issue and the relief you are seeking. We will attempt to resolve disputes in good faith.

Informal resolution period: at least 30 days from the date we receive your notice. If the dispute is not resolved within this period, either party may proceed with a claim in the courts identified in the governing law and jurisdiction section, unless applicable law requires a different venue.

13) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, misused the Site, or created risk or legal exposure for SaborPatio LLC or other users.

You may stop using the Site at any time. Termination does not affect any rights or obligations that, by their nature, should survive termination, including intellectual property rights, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution provisions.

14) Modifications to these Terms

We may update these Terms from time to time to reflect changes to the Site, legal requirements, or our business practices. When we update the Terms, we will revise the “Last Updated” date at the top of this page.

Unless a change must take effect sooner for legal reasons, changes will be effective 14 days after they are posted. Your continued use of the Site after the effective date constitutes your acceptance of the updated Terms.
